Memorandum that on the 27th Nov. 20 James [1622] Jasper Willott of Tiderington, co. Chester, yeoman, Humphrey Swindells, senior, of Rainow 
yeoman, Humphrey Swindells, junior, of Rainow yeoman, and Edward Barber of Tiderington, yeoman, at Prestbury within the Manor and Forest of 
Macclesfield, came before Sir Urian Legh, Knight, Kings locum tenens for the Right Hon. William, Earl of Derby, Steward for the Very Noble 
Lord Charles Prince of Wales as Earl of Chester of his Manor and Forest of Macclesfield Robert Yeveley, Laurence Pott, Francis Broadhurst 
and William Burges, Clerk of the Court of the Manor and Forest aforesaid, and other faithful persons then being present.   And surrendered into the 
hands of the said Prince as Lord of Macclesfield 1 close of land in Rainow, commonly called Le Herre Esburie late in the occupation of John 
Swindells of Rainow, with all its appurtenances.  To this intent that the said land should be granted to John  Hooley of Rainow, yeoman, his heirs 
and assigns for ever, at the annual rent of 7d. to be held of the Lord the Prince, according to the custom of the Manor and Forest aforesaid.  And 
thereupon the said land was so granted and full seisin of the same was given to the said John Hooley who paid for a fine 7d. by the pledge of 
Francis Broadhurst.

21 This Indenture made the 1st May 21 James I [1623] Between Arthur Davenporte of Calveley co. Chester, Esquire, and Lawrence Hooley of Ranow in 
the said county yeoman, Witnesseth that in consideration of the surrender of a former lease, made by the said Arthur Davenporte unto the said 
Lawrence Hooley, of the lands hereinafter mentioned, for the term of the lives of Lawrence Howley, John Howley, his son, and Henrie Hooley, brother 
of the said Lawrence Hooley, and in consideration of a certain sum of money to the said Arthur Davenporte paid by the said Lawrence Hooley, the 
receipt whereof the said Arthur Davenporte doth hereby acknowledge .  And for other good considerations, he the said Arthur Davenport Hath let to 
farm to the said Lawrence Howley, all those lands &c. of the said Arthur Davenporte in Ranowe aforesaid, now in the occupation of the said 
Lawrence Hooley or his assigns, To have and to hold for his life , and for the lives of the said John Howley, his son, and of Katherin, wife of the said 
John, paying the yearly rent of 21s.8d by even portions, and two rent capons yearly at the feast of Easter, with power of distraint for non-payment of 
rent.  And the said Lawrence Hooley doth covenant with the said Arthur Davenporte in manner and forme following, that is to say, “That when and so 
often duringe the said terme as hee the said Arthur Davenporte in his lief tyme or afterwards, such person or persons respectivelie to whom the 
imediate Revercon or Remainder of the premises shall certenlie belonge, shall serve in his or their owne persons in the wars of our  Soveraigne Lord 
the King’s Majestie that now is, his heirs, or successors, or shall furnish or sett forwards any man or men towards the said warrs that then and soe 
often the said Lawrence Hooley and his assigns shall and will finde, provide for, have in readiness, and sett forth, one sufficient and Able Billman, 
with a plate coate and a sculle, to serve and attend upon the said Arthur Davenporte and his heirs in the warrs aforesaid, in such place, rowne, 
degree, and service of a billman as shall be assigned or appointed by the said Arthur Davenporte or the said person or persons aforesaid.”  And also 
that the said Lawrence Hooley, during the life-time of the said Arthur Davenporte and afterwards, pay herriotts &c according to the quantity of his rent.  
And the said Arthur Davenporte doth covenant with the said Lawrence Hooley, to grant the said lands &c in manner aforesaid, Provided that it shall 
be lawful for the said Lawrence Hooley and his assigns during the said term, to make marlepitts upon the premises,  to dig and get marle for the 
mending of the premises.  Provided also that the said Lawrence Hooley or his assigns shall not grant the said lands &c. to any person, without the 
consent of the said Arthur Davenporte, or his heirs, except to his wife or children, And moreover the said Arthur Davenporte hath made Edward 
Jackson and Richard Normansell his lawful attorneys, to deliver full possession of the said premises to the said Lawrence Hooley or to his attorney.

Memorandum that on the 4th July I Charles [1625], Edward Jackson, junior of Hurdsfield co. Chester, yeoman, in his proper person at Adlington, 
came before Sir Urian Legh, Knt. locum tenens of the said Steward, Edward Green, Robert Yeveley, Richard Normansell, John Hooley and William 
Burges Clerk of the Court of the Manor and Forest aforesaid, and other faithful persons then being present, And produced a letter of Attorney from 
Arthur Davenport of Calveley, to surrender all the common lands in Rainow lately granted to him the said Arthur Davenport containing about 40 acres 
of Cheshire measure To the intent that the same should be granted to Lawrence Howley of Rainow yeoman, for the lives of the said Lawrence, and 
John Howley, son of the said Lawrence, and Katherine, wife of the said John at the yearly rent of 12d.  And by virtue of which letter of Attorney the 
said lands were surrendered and regranted accordingly.  And now in full Halmote held the 25th July the said Lawrence Howley came in his own 
proper person and was duly admitted into the said land according to the custom of the Manor  and Forest, paying a rental to the said King as Lord of 
Macclesfeild of 10s 6d for the said lands.  And the said Lawrence gave to the said King for a fine, the sum of 10s 6d by the pledge of John Howley.

hereafter herein declared, specified or mencoed in  manner and forme hereafter expressed That is to Say of and in one Close and pcell of lande 
beinge prcell of the premises lynge or beinge in Keridge within Ranowe aforesaid and contayninge by estimacon Tenne Acres of Grownde or 
thereaboute bee it more or lesse of the measure aforesaid with its apptennce, And alsoe of and in a full thirde parte of residue of the said Closes, 
landes and growndes aforesaid with their appurtennce into three equall pte devided imeadietli from henceforth to the use and behoofe of the above 
named John Howley and his executors and assigns for and duringe all the tyme  of the lives and leife thabove named Lawrence Howley, John 
Howley and Katherine his wief and the lief naturall of the longest lyver of them .......

Lawrence Howley of Rainow co. Chester, yeoman in his proper person came here in full Halmote the day and year above said, before Sir Edward 
Fitton Bart, locum tenens for the said the Steward, Lawrence Downes Esq., Francis Pott, gent, Thomas Shrigley of Bollington, and William Burges, 
Clerk of the Court of the Manor and Forest aforesaid, and other pesons there being present  And received from the said Lord the King as Lord of 
Macclesfield, by the hands of the said Steward , all the lands lying in Rainow in  the said Forest being about 8 acres of Cheshire measure, more or 
less, lately allotted to the said Lawrence Howley as common land, by virtue of an agreement made by the Commissioners on behalf of the Prince of 
Wales on the one part, and Roger Downes Esq. Francis Pott, William Clowes, gentlemen, and Richard Normansell, customary tenants of the said 
manor on behalf of themselves and the other customary tenants of the said manor, and granted in the Exchequer of the said King at Chester, the last 
day of May 19 James [1620]. He the said Lawrence paying thence the yearly rent of 2s. And thereupon full seisin of the said lands was granted to the 
said Lawrence and he paid as a fine for the sum of 2s. by the pledge of John  Howley.

23rev    ref 77 Memorandum that on the 26th Oct 6 Charles [1630] Lawrence Howley of Rainow, co. Chester, yeoman in his proper person at Macclesfield, 
in the Court House there, came before Sir Edward Fitton Bart. locum tenens for the Right Hon. William, Earl of Derby, Steward for the Lord the King, 
for the manor and forest of Macclesfield aforesaid, Thomas Turner. Henry Jackson, George Shrigley, and William Burgess Clerk of the Court of the 
Manor and Forest of Macclesfield aforesaid, and other faithful persons then being present.  And surrendered into the hands of the said Lord the King, 
according to the custom of the said manor and forest, all those common lands in Rainow containing about 8 acres of Cheshire measure, lately in the 
manor and forest aforesaid granted to the said Lawrence Howley. To this intent that the said lands should be divided into three parts, one third part 
of which should be given to John Howley son of the said Lawrence Howley, and the other two parts should remain to the said Lawrence Howley for 
the term of his life, and after his decease to the said John Howley, and the said lands were accordingly so re-granted and the said Lawrence and 
John shall pay to the said King for a fine, the sum of 2s.

John Howley of Rainow co. Chester, yeoman in his proper person came here in the full Halmote the day and year aforesaid, before Sir Edward Fitton 
Bart, locum tenens for the said the Steward, Lawrence Downes Esq., William Clowes, Humphrey Swindells, and William Burges, Clerk of the Court of 
the Manor and Forest aforesaid, and other faithful persons then being present, And surrendered into the hands of  the King as Lord of Macclesfield, 
according to the customs of the Manor and Forest aforesaid, 1 Close of land, lying in Rainow, and commonly called the Great Edesburie, with all its 
appurtenances, and containing about 5 acres of Cheshire measure, To this intent that the said land should be granted to Edward Jackson of 
Ingarsley, and Thomas Normansell of Bollington, yeoman,  in trust to carry out the provisions hereinafter mentioned, and thereupon the said land was 
so granted and full seisin thereof was delivered to the said Edward Jackson and Thomas Normansell, who paid for a fine for the same 22d. by the p
ledge of the said John Howley.

with three severall Conditions thereupon indorsed or thereunto subscribed for  the payment of Three severall somes of Tenne Powndes at daies 
hereafter to  come NOWE for the discharginge and saveinge harmeles of him the said Thomas his heires, Executors and assigns of and from the 
same, and alsoe for the discharginge and saveinge harmeles of the said Edward Jackson and Thomas Normansell and either of them.

William Clarke of Rainow near Macclesfield, co. Chester, yeoman, and Thomas Clarke, son and heir apparent of the said William, and Ann wife of the 
said Thomas, came here in full Halmote before Thomas Legh Esq., locum tenens for the Right Hon. Charles Earl of Derby Steward, of the said the 
Manor and forest, John Massie, Joseph Stonhewer, Christopher Byron, John Jackson, and John Watson,  clerk of the Court of the manor and forest 
aforesaid, and other true and faithful persons then being present.  And surrendered a piece of land in Rainow, containing about 1 acre of Cheshire 
measure, and lying near a certain brook called Girdshawe Brook on the East side of a certain placed called Macclesfield Forest, and also near the 
land of John Lowe the Marsh in Rainow and lately with other common land granted to the said William and Thomas Clark. To this intent that the same 
should be re-granted to John Howley of Rainow, yeoman, his heirs and assigns for ever.  And the same was so granted accordingly.

This Indenture made the 18th day of March 1652 Between Jasper Hooley of the One House in Ranowe co. Chester, yeoman and William Pickeringe 
of Macclesfeild in the said county yeoman.  Witnesseth that the said Jasper Hooley in consideration of the sum of £11 to him by the said William 
Pickeringe, before the sealing hereof, paid, wherof he acknowledge the receipt, & doth discharge the said William and his executors for ever by 
these presents.  Hath let to farm unto the said William Pickeringe and his assigns all that his messuage and tenements situate in Macclesfeild 
aforesaid, in the said county, in a certain street called Back streete, now or late in the occupation of one Edward Pott with all their appurtenances.  
To have and to hold the said messuage &c. to the said William Pickeringe from the 5th May, next ensuing, for the lives of Margarett Pickeringe, Jane 
Pickeringe, and Mary Pickeringe daughters of the said William Pickeringe, Paying therefore yearly unto the said Jasper Hooley, and his heirs, the rent 
of 5s. And if it shall happen that the said yearly rent 5s. be unpaid ten days after the day whereon it ought to be paid, it shall be lawful for the said 
Jasper Hooley to enter and distrain. And the said Jasper Hooley doth hereby promise that the said William Pickeringe and his heirs shall occupy the 
said premises quietly and peaceably.  And lastly the said William doth agree with the said Jasper Hooley to keep the said premises in good and 
tenantable repair during the term aforesaid.  Signed and sealed the day and year first above mentioned.

in Ranowe or elsewhere within the Mannor and fforest aforesaid  conteyneing by estimacon forty two acres of land or hereabouts bee the same more 
or less of Cheshire measure and now in the tenure holding or occupation of John Howley of the One house in Ranowe aforesaid yeoman or his 
assigns, togeather with all houses, barnes, and stables, orchards, gardens, lands, meadowes, leasoes, pastures, feedings, common of pasture and 
turbary, waies, waters, water courses, comodities, proffitts and advantages whatsoever to the same customary or copihold landes and premises 
lyeing, belonging,  or in any wise appertaineing And the Revercon and Revercons, Remainder and Remainders thereof and of every part and parcell 
thereof wth thappertances To the intent and purpose that the said Keepers of the Libertie of England by authoritie of Parliamt haveing seisin thereof 
by their Steward of the Mannor and fforest aforesaid or his Deputie would give and grant all and every the aforesaid customary or copihold landes 
and all other the premises aforesaid with their appertenances Unto the said John Howley of the One House within Ranowe aforesaid in the said 
County of Chester yeoman his heirs and assignes To have and to hold to him the said John Howley his heirs and assignes, for ever, To and for the 
onely sole and proper use and behoofe of  him the said John Howley his heirs and assignes, for evermore, To be held of the Keepers of the Libertie 
of England by authoritie of Parliament and the Keepers of the Libertie of England by authoritie of Parliament and their Successors Lords of 
Macclesfeild aforesaid by the rents and services therefore due and of right accustomed, according to the custom of the Mannor and fforest aforesaid, 
ratifying and confirmeing all and whatsoever our said Attorneys or either of them in our names or in the name of either of us, shall doe in the 
premisses, in as full and ample manner and forme to all intents and purposes as we or either of us could or ought to doe, if we were personally then 
and there present. In witness whereof wee have hereunto sett our hands and seales, the five and twentieth day of July in the yeare of our Lord God 
one thousand sixe hundred fiftie and three.  And the said Thomas Jackson according to the power given him by the said warrant of Attorney, and in

England by authority of Parliament being therefor siesed by their Deputie Steward aforesaid Have given and granted all and singular the said 
customary or copihold landes and premises in the said Warrant of Attorney menconed and expressed, with their and every of their appurtenances,  
and the Revercon and Revercons , Remainder and Remainders of the same premises  to the aforesaid  John Howley his heirs and assigns To have 
and to hold the said customary or copihold landes and premises in the said warrant of Attorney menconed and expressed and all the heredictaments 
and premises aforesaid with their and every of their appurtenances  And the Revercon and Revercons , Remaynder and Remainders of the same 
unto the said John Howley his heirs and assignes, for ever, To bee held by the Keepers of the Libertie of England by authoritie of Parliament and their

said John Howley, party to these presents, his heirs male in tail male, and in default of such issue  then to the use of Charles Howley, fifth son of the 
said John Howley party to these presents, his heirs male in tail male, and in default of such issue  then to the use of the right heirs of the said John 
Howley party to these presents.
With a clause directing a certain messuage in Ranowe leased by George Davenport Esq., late of Calveley co. Chester, by an indenture dated 21 
Sept 14 Charles (1638) to John Evans of Diglake, co. Flint, gent. And John Williams of Rushton co. Chester, gent, for the term of 1000 years, which 
messuage had been conveyed to the said John Howley to be held under the same trusts and to the said uses.
With clauses for the payment of annuities to the said Elizabeth and Rebecca if they survive their respective husbands and for the settling of annuities 
on any other women they the said John Howley and Jasper Howley may marry, and also for making payments on behalf of the daughters of the said 
Jasper should he die without leaving issue male surviving.

WILL OF JOHN HOWLEY THE ELDER OF RAINOW 1675
IN the name of God Amen the Twenty third day of February In the Seven and Twentieth yeare of the Reigne of our Soverigne Lord Charles the 
Second by the Grace of God King of England Scotland France & Ireland defender of the faith Etc. I JOHN HOWLEY thelder of the one house in 
Ranow in the County of Chester yeoman being Aged and weake in body But in good and perfect memory praised be god for the same, And 
weighinge and considering with my selfe the frailty of mans life that Death to all men is most certaine and the tyme and hower of death most 
uncertaine doe therefore make & ordaine this my last will and Testamt for the settleing and disposeinge of that Temprall Estate wherewith it hath 
pleased god to Bless me, But first and principally I commend my soule into the hands of Almighty God my maker stedfastly wishing that through the 
merritts of Jesus Christ my Saviour I shall have the full pardon and remission of all my Sinns My Body I committ to the earth to be Interred at the 
discretion of my executors hereafter named in the pachiall Chappell of Macclesfield in decent manner, And as for that Tempall Estate wherewith it has

decease unto the said EDWARD HOWLEY my son and the heires of his body lawfully begotten or to be begotten, And as to my goods Cattels & 
Chattels, I give bequeath & dispose of the same in manner & forme followeing, And first I give & bequeath to my loveinge wife ELIZABETH 
HOWLEY the gray mare wch. was her mothers if I die possessed of her the new press in the parlor her trunke A great Brass Candlesticke & a 
pewter dish wch. were her mothers, And a full thirde parte of all my personall Estate to be taken upp for her use Immediately after the paymt. of my 
debts & funerall expences and Harriotts before any other legacy be taken out, Item I give & bequeath unto JOHN HOWLEY my son apaire of new 
iron bound wheels A cart chest an axletree kipe board axletree pine washers & all other matterialls thereto belonginge, Item I give & bequeath to my

Margaret, wife of the said Humphrey Swindles of the parish of Prestbury, in the 40th year of her age, says:
....to the 2nd, 3rd, 4th and 5th articles ‘that in some of the months stated, matrimony was solemnised betwixt the said Thomas Oldfield and Ellen 
Oldfield alias Hooley, as she hath credibly heard... .they lived for a certain time after together as man and wife and were so reputed and taken’, 
as she believes 
....to the 6th article ‘that at the time of her marriage she the said Ellen had attained to the fourteenth year of her age’ as she believes
....to the first article ‘that she hath heard credibly reported that she the said Lawrence Hooley’s son procured a licence from this court for the 
solemnising of marriage betwixt Thomas Oldfield and Ellen Oldfield alias Hooley’
....to the fifth article they say ‘that after the said Thomas Oldfield and Ellen his wife did allege and affirm that they were married together, they did 
inhabit and dwell together in the same house as man and wife for the space of twenty weeks or thereabouts in their (i.e. the Hooleys’) house and 
sometimes lay together in one and the same bed within the same time and that the said Thomas and Ellen are commonly reputed and taken for 
man and wife’
....to the sixth article they say ‘that the said Ellen, at the time that it is affirmed she and the said Thomas Oldfield were married together, was fifteen 
years of age or thereabouts’ 
....to the seventh article they say ‘that the said Ellen did affirm unto them that the said Thomas Oldfield her husband did strike and menace her, and 
said she durst not continue with the said Thomas for danger of her life, and thereupon the said Ellen of her own accord, as they believe, departed 
and absented herself away from the said Thomas Oldfield without authority of law, as they believe’

.....to the fourth article they say ‘that the said Thomas and Ellen did affirm unto them that they were married together’ which they do not believe to be 
true, ‘saving that they do believe that the said Thomas and Ellen were free from any former contract, as they believe, before their promised marriage’
....to the second article he says ‘that there was an agreement to the like purpose and effect, mentioned in this article, made betwixt the parties 
likewise mentioned in this article’ 
....to the third article ‘that the last time this deponent saw the said Ellen Oldfield was at this deponent’s house’
....to the fourth he says ‘that after the said Ellen’s departure from this deponent’s house this deponent hearing that she went not home to her father’s 
and mother’s as she said she would, and fearing least this deponent and his wife should come into trouble in respect of the premises this deponent’s 
said wife went to the said Ellen’s father’s house and finding her mother within, brought her to this deponent who asked where her daughter Ellen was, 
and she answered she could not tell, whereupon this deponent said if she be in Cheshire I will find her, and then the said Ellen’s mother said 1 have 
heard from her the said Ellen and she is well and I thank God hath met with her friends or to the like effect, before should come to any harm she the 
said Ellen should be fetched home again’

HOWLEY of the Hough in the parish of Wilmeslow in the County of Chester Yeoman being sick and weake in body but of sound and perfect mind 
and memory, praised be God for the same, knowing the certainty of death and the uncertainty of the time thereof do make and ordaine this my last 
Will and Testament in manner and forme following. FIRST and principally I commend my Soul to Almighty God my Creator hopeing through the 
merit of my blessed Savior Jesus Christ to receive pardon for all my Sinnes and life eternall And my body I committ to the Earth to be buryed in

to be paid to her or her assignes wthin One year next after she or they enter upon the sd. Messuage and Tenemt. or in default of such paymt. thereof 
the Trustees in the said Assignmt. shall stand & be possessed thereof for the raising of the same over and above all costs and charges for the use of 
the children of the said JOHN HOWLEY THOMAS HOWLEY and CHARLES HOWLEY equally to be devided amongst them and to be put forth &

the sd. EDWARD WHITTAKERS to assigne the sd. Messuages and Tenemts for the use of the wife and children of the said PHILIP TABER as he 
the sd. EDWARD WHITTAKERS shall thinke fitting.
AND concerning my personall Estate it is my Will and mind that my funerall expenses and Heriot for my Messuages and Tenemt in the Houghe 
aforesd. and the charges of the pbat of this my Will shall be first deducted out of my whole prsonall Estate ITEM I give unto the sd. EDWARD 
WHITTAKERS fifty shillings & my housebrasse clocke and to his daughter ELIZABETH WHITTAKERS ten pounds and to ELIZABETH HOWLEY 
daughter of my brother JOHN HOWLEY ten pounds of lawfull money of England ITEM I give one seiled Chest in the parlor to the sd. ELIZABETH 
HOWLEY (my wife if she please to have the use of it dureing her life) and another seiled Chest in the Chamber I give to the sd. ELIZABETH 
WHITTAKERS And I give to the sd. JASPER HOWLEY my coat and vest wth the plate Buttons, and to the sd. PHILIP TABER my gray freize Coat 
and gray vest and plush breeches and the rest of my Wearing apparell to JOHN HOWLEY and THOMAS HOWLEY my sd. brother and Uncle 
THOMAS HOWLEY And of all the rest residue & remainder of my goods Cattells and Chattells whatsoever One full third part thereof I give and 
bequeath to the said ELIZABETH HOWLEY my wife hopeing she will be therewth content and pleased And the then residue and remainder thereof  
I give and bequeath to all the children of the sd. JOHN HOWLEY THOMAS HOWLEY and CHARLES HOWLEY my sd. brothers equally to be 
devided amongst them And if any of them happen to dye before they attaine to the age of One & Twenty Years the Survivors of them shall have his 
her or their partes soe dyeing of my personall Estate and all other Legacies or Summes of money given them before in this my last Will and Testamt. 
equally devided amongst them and such of them as shall happen to be under the age of One & Twenty years at the time of my decease that the 
fathers of such sd. children respectively shall put forth & imploy all their legacies or summes of money given unto them by this my sd. last Will and 
Ttestamt. for their uses untill their attainmt. of the age of One and Twenty years aforesd. Except for the children of my sd. brother JOHN HOWLEY; 
their legacies or summes of money to be put forth and imployed for his children by my Exec.rs herein after named untill they come to the age of One 
and Twenty years aforesd. AND of this my last Will and Testamt. I constitute ordaine and make my loving wife the sd. ELIZABETH HOWLEY and 
the sd. EDWARD WHITTAKERS my true and lawfull Executors to execute and performe the same in all things according to my trust reposed in 
them. IN WITNES whereof I have hereunto sett my hand and seale the day and year first above written.
