1890 09 Sep - Birmingham Daily Post - A Desperate Ruffian - Francis William Hulley (21), farm labourer, was
apprehended at Droylsden yesterday for burning four haystacks and attempting to murder Amelia
Bonsall, a farmer's daughter, at Macclesfield, on the 23rd of August. (also in the Liverpool Mercury same
day)

Saturday, before Mr. Justice Vaughan Williams.
EXTRAORDINARY SENSATION AT MACCLESFIELD. FIENDISH OUTRAGES.
Francis William Hooley, alias Hulley, (21), silkboiler, was indicted for attempting to murder Amelia
Steele Bousell, at Sutton, near Macclesfield, and for setting fire to a farm building in the same locality.
Mr. E.H. Lloyd prosecuted, and prisoner was defended by Mr. Marshall. The case of attempted murder
being taken first, Mr. LLOYD said the prisoner was charged on an indictment containing various counts
with having assaulted Amelia Steele Bousell with intent to murder her, or do her grievous bodily harm.
Miss Bousell lived with her father at Sutton, near Macclesfield, and the prisoner’s father’s house was
close by. On the evening of the 23rd August Miss Bousell was going home by a footpath leading
through a field between the two houses when she was stopped by the prisoner, a slim-built young man,
who said she was trespassing, followed her up the field, knocked her down with a blow on the face,
seized her by the throat, crammed mud in her mouth, threatening all the while that he would “murder
her dead.” This continued until the girl became insensible, and her father, hearing the scuffle, ran to her
rescue and knocked her assailant down. The girl was taken home, where her injuries were attended to
and a doctor and the police were summoned.
Amelia Steele Lomax, a comely young woman, daughter of Mr. George Bousell, was first called, and
explained that she had been married since this case arose. In describing the assault, she said that after
knocking her down the prisoner pushed her headlong down the field, saying “I am drunk, and can do
whatever I like with you, I will murder you,” and uttering such like threats. While she lay on the grass he
kept pinching her throat and strangling her.” At last she became insensible, and remembered nothing
till she heard a scuffle and prisoner crying “Oh, father do come, I am dying.” Then she recognised her
father’s voice rejoining, “ You ought to have been dead many a year since.”
Cross-examined: She did not hear her father threaten to cut or rip the prisoner’s heart out, nor did she
intercede with him, “Oh, father, don’t kill him.”
The father’s evidence was in effect, that when about to go to bed on the night in question, he heard a
sound as of a cat choking - (laughter) - and afterwards hearing someone say, “ I’ll murder thee,” he went
out without his boots in the direction of the sounds, with the result that he found in the field a man
maltreating a woman. He separated them and knocked the man down. It was then he discovered in the
assailant the prisoner, and in the prostrate form his daughter. The girl’s face was covered in blood,
bruises, and mud. He took her home and sent for a doctor and the police.
Cross-examined: He did not know why the prisoner exclaimed” Father, I am dying.”
Mr. MARSHALL: I suppose you were hurting him pretty much? Well, I was sticking to him.
Were you very quiet or very angry? I was angry after I heard my daughter cry out, but not till then.
His LORDSHIP: You did not know it was your daughter, and then you took the very proper course of
knocking him down? Yes, and I should do it again if I had it to do.
Dr. Hughes described the girl’s injuries as follows:- Injury to both temples, more especially the left; finger
marks on the neck; cut on the upper lip; marks of violence on the right chest bone. The patient was
suffering greatly from shock and excitement, and he attended her for a fortnight.
Cross-examined: He could not say from the marks that there had been any attempt to murder, but the
tightening of the fingers on the throat might have extinguished life.
Superintendent Downes deposed to searching in vain for the prisoner, and to receiving him from the
Ashton-under-Lyne police on 8th September. Prisoner, when charged, admitted the assault, but denied
murderous intention.
Mr. MARSHALL, addressing the jury, on the prisoner’s behalf, utterly ridiculed the charge of attempted
murder as altogether untenable, holding that the injuries, even according to the evidence of the
prosecution, was not such as would for a moment justify a conviction either for attempted murder or
grievous bodily harm.
His LORDSHIP, in summing up, directed the jury that no case of attempted murder had been made out.
The jury found the prisoner guilty of unlawful wounding.
Prisoner was next put on his trial for arson, and in opening this part of the case, Mr. LLOYD said the
offence with which the prisoner now stood charged was alleged to have taken place in the same
neighbourhood on the same night, and almost immediately after the assault on the girl. About nine
o’clock that evening the prisoner confided to a man named Mason that Mr Millward, the famer, had been
accusing him (prisoner) of unhinging his gates, and that he (prisoner) would make it warm for Millward.
Soon afterwards prisoner, in the prescence of Bousell, Miss Bousell, and Mason, was heard proclaiming
that he would make the Sutton farm ablaze, and that there would be more fires in that neighbourhood
than there were in hell. Within an hour of that time there were no fewer than four farms on fire within 400
yards of that spot. The farms selected for these outrages were Mr Millward’s (where damage to the extent
of £200 was done), Mr Truman’s, Mr Bousell’s, and Mr Bowler’s. At half-past one o’clock in the morning
three members of the fire brigade found prisoner crouching behind a fence at Mr Millward’s farm, while
the fire was still in progress.
Evidence having been given for the prosecution, Mr MARSHALL called witnesses for the defence, and
submitted that this was simply a case of circumstantial evidence, that there was an entire absence of
motive on the prisoner’s part, that the story of prisoner’s proclaiming his intentions to the world was
exceedingly improbable, and that the conflagration might have been caused by tramps as some act of
revenge.
The jury found the prisoner guilty of arson also, and being asked what he had to say why sentence should
not be passed upon him, Prisoner, who seemed taken aback at the result, of the trial, said: I have nothing
to say only I am innocent.
His LORDSHIP: I am sorry to say, sir, I cannot give any credence at all to your last statement that you are
innocent. It seems to me that the offence has been brought home to you in the clearest possible manner,
and under these circumstances I think I should be departing from my duty very much if I did not treat this
as a very serious offence indeed. Now under these circumstances I shall send you to
PENAL SERVITUDE FOR EIGHT YEARS.
With regard to the other offence, the assault on Amelia Bousell, I shall pass a merely nominal
punishment, that you be imprisoned and kept to hard labour for one week.
