This is the last Will AND TESTAMENT of me ROBERT HULLEY of Stockport in the
County of Chester Hatter made and published this Tenth day of February in the year of
our Lord One thousand and eight hundred in manner and form following, (that is to
say) First I order and direct all my just debts and Funeral and Testamentary charges to
be paid by my Executors hereinafter named out of my Personal Estate which I do
hereby subject and charge with the payment thereof accordingly I Give devise and
bequeath All Those my four several Messuages or Dwellinghouses Hatt Shop and
Outhouse with the Land and other the Appurtenances thereunto respectively belonging
situate standing and being in Canal Street in Stockport aforesaid, And also all and
every my Household and other Goods and Furniture Chattles and Implements in trade
and all other my Estate and Effects of what nature and kind soever and the Rents
Issues and Profits thereof and of every part thereof to my dear and loving Wife SARAH
and her Assigns for and during the term of her natural life without arising any wilful or
voluntary waste to the same and keeping the same in good and tenantable repair and
Condition and paying the Interest of the sum of One Hundred and twenty Pounds and
also paying all and every encumbrances thereupon during the said Term of her natural
life (Save and except the said Principal Sum of One Hundred and Twenty Pounds
which I borrowed of JOHN HUTCHINSON of Stockport aforesaid Hatter), AND from and
immediately after her decease I give devise and bequeath The said Four several
Messuages or Dwellinghouses Hatt Shop and Outhouse with the Land and other the
Appurtenances thereunto respectively belonging And also all and every my Household
and other Goods and Furniture Chattles and Implements in trade and all other my
Estate and Effects of what nature and kind soever Unto my Two Friends SAMUEL
SLACK of Stockport aforesaid Tailor and PETER WALKER of Stockport aforesaid
Bricklayer their Heirs and Assigns for ever Upon Trust NEVERTHELESS that they my
said Trustees and the Survivors of them his Heirs or Assigns shall and do as soon as
convenient maybe after the decease of my said Wife SARAH make sale and absolutely
dispose of the said Four several Messuages or Dwellinghouses Hatt Shop and
Outhouse with the Land and other the Appurtenances thereunto respectively belonging
and all other my Personal Estate and Effects of what nature and kind soever either
together or in Parcels and by Public Auction or by Private Sale as to my said Trustees
shall seem meet and for the best price and prices and most money that can or may be
reasonably gotten for the same UPON which sale or sales and the Conveyance and
Conveyances to be made in pursuance thereof the receipt and receipts of my said
Trustees and the Survivor of them his Heirs or Assigns shall be a good discharge and
good discharges to the Purchaser or Purchasers of the said Four several Messuages
or Dwellinghouses Hatt Shop and Outhouse with the Land and other the
Appurtenances thereunto respectively belonging and all other my Estate and Effects
respectively for his her or their purchase money or monies and such purchaser or
purchasers shall not afterwards be answerable for the same or for the misapplication
or nonapplication thereof AND as to the money to arise by sale of the said Four several
Messuages or Dwellinghouses Hatt Shop and Outhouse with the Land and other the
Appurtenances thereunto respectively belonging and all other my Estate and Effects
hereinbefore Devised to be sold, I do hereby order and direct my said Trustees and the
Survivor of them his Heirs or Assigns that they shall place and continue the money
arising from such Sale upon such Securities as they or the Survivor of them his Heirs
Executors or Administrators shall judge prudent and from time to time call in the same
and change such Security or securities and pay and apply the interest arising
therefrom in the maintenance education and bringing up of my Children until he she or
they shall attain the age of twenty one years, AND I do hereby order and direct my said
Trustees to pay apply and divide I also give devise and bequeath the same unto and
amongst my Four Children, namely JAMES, ROBERT, HANNAH and SARAH and the
issue of such of them as shall be then dead leaving issue (such issue nevertheless to
take only such share or shares as the Parent of Parents of such issue could if living
have taken) and their respective Heirs and Assigns equally share and share alike
which said sums of money or any part thereof shall not be subject to the controls debts
or engagements of either of my said two Daughters Husbands and which my said two
Daughters receipts only (notwithstanding their Coverture) shall from time to time be a
sufficient discharge and discharges to my said Executors, And I do hereby nominate
and appoint the said SAMUEL SLACK and PETER WALKER Executors of this my last
Will and Testament hereby revoking all former Will and Wills Codicil and Codicils by
me at any time heretofore made and declaring this only to be my last Will and
Testament, And I do hereby Will and declare that it shall and may be lawful to and for
my said Trustees and Executors out of the said Trust monies which may come to
their Hands by virtue of this my Will from time to time to deduct and retain all costs
charges and expences which they or either of them may sustain or expend (together
with a reasonable allowance or compensation for their loss of time and trouble in the
execution of the Trusts aforesaid) And that my said Trustees and Executors
respectively shall not be answerable or accountable for nay loss of monies by placing
the same in any Bank or Bankers Hands or placing the same out at Interest on
Government Security or elsewhere for safe Custody or for any other loss which may
happen without their respective wilful neglect or default nor shall the one of them be
answerable or accountable for the other of them or for the Acts Deeds receipts or
defaults of the other of them but each of them for his own Acts Deeds receipts and
Wilful defaults only, In witness whereof I the said ROBERT HULLEY the Testator have
to this my last Will and Testament set and put my hand and Seal the day and year first
within written.

This is the last Will and Testament of me ROBERT HULLEY of Stockport in the County of Chester
Publican made this twenty fourth day of January in the year of our Lord One thousand eight hundred and
twenty nine as follows I order all my just Debts and funeral and Testamentary expences to be paid out of
my Personal Estate except all and every the Debt or Debts that I owe upon mortgage of my real Estate
and which Debt or Debts I charge expressly upon my real Estate and hereby expressly exempt my
Personal Estate from the payments thereof I give and bequeath all my Personal Estate and Effects
whatsoever and wheresoever unto my dear Wife MARY ANN and my Friend EDWARD TURNER of
Stockport Tallow Chandler upon Trust to permit and suffer my said Wife to use and enjoy the same
Personal Estate and Effects for and during her natural life for her own maintenance and the maintenance
education and bringing up of my children until they shall attain the age of twenty one years and upon
their attaining that age upon Trust to divide the same unto and equally amongst my said wife and my
said Children respectively and in case any of my said Children shall die before receiving their share of
my said Personal Estate and Effects leaving issue I give such issue the share or shares of their
respective parent or parents so dying.
I give and devise all my Real Estate ( subject to the payment of my Mortgage Debt or Debts thereon) to

Proceeds of such sale unto and equally amongst all and every my children then living or the issue of
such of them as shall be then dead leaving issue, such issue nevertheless to take no further or other
share than their respective parents would if living have been entitled to. And for facilitating any such Sale
or Sales of my said Real estate to be made as aforesaid I do declare that the Receipt or Receipts of the
said EDWARD TURNER or his Heirs for the Purchase money upon such Sale or sales shall be a good
and sufficient discharge or discharges for the money therein acknowledged to be received and that such
purchaser or purchasers shall not be answerable or accountable for such purchase money or be liable to
see to the application thereof And in case the mortgage Debt or Debts now owing by me on my Real
Estate shall be called in at any time after my decease I authorize my said Executrix and Executor and the
Survivor of them and their Heirs Executors and Administrators of such Survivor to borrow at take up at
Interest upon my said Real Estate all and every such Sum and Sums of money as shall be sufficient to
pay off and discharge the said mortgage Debt and Debts and all expences attending the same And I do
declare that the Receipt or Receipts of my said Executrix and Executor and the Survivor of them and their
Heirs Executors and Administrators of such Survivor shall be a good and sufficient discharge or
discharges to the person or persons lending the money requisite for carrying into Execution the Trusts of
this my Will and that such person or persons shall not be liable to see to the application thereof or liable
to the misapplication or nonapplication thereof And I direct and declare that my said Executrix and
Executor and the Survivor of them and his Heirs Executors and Administrators of such Survivor shall and
may deduct and retain to himself herself and themselves all reasonable costs and charges in the
Execution of this my Will also a suitable recompense for their care and trouble And I declare that the
share and shares and Interests of and in my said Real and Personal Estate hereinbefore given to my
said Children respectively are meant and intended for their own use and benefit free from the control or
engagement of any Husband with whom they being a Female or Females may happen at any time to be
married and that the Receipt or Receipts of such Female and Females shall be a good discharge and
discharges to my said Executrix and Executor and the Survivor of them and their Heirs Executors and

1831 16 May - Probate of husband's Will granted: Note written in the left hand margin of page 4:-
The sixteenth day of May 1831. MARY HULLEY one of the Executors in this Will names as sworn in
common form (Power being reserved to EDWARD TURNER the other Executor therein also named to
take upon him the Execution of the said will whenever he shall Lawfully request the same) & she further
made Oath that the Personal Estate and Effects of the Testator within the diocese of Chester were under
the value of 300£.

At the Kings Arms Hotel Castle Street in Liverpool on the 19th day of August 1835
Exhibited to DANIEL OLDHAM a Witness and by him deposed unto
Will: Shawe Regr.

1831 21 Oct - Chester Chronicle STEALING A BRASS PIPE - William Longshaw, (20) and James Whittaker, (21) were
indicted for stealing a brass pipe, the property of Mary Ann Hulley. Mr. Cottingham stated the case, and
called the prosecutrix, who stated that on the 20th Sept. the prisoner came in to the house, the Boar's -
head, in Stockport, and called for a pint of ale; and a short time after they were gone, she missed the
brass pipe, out of the tap-room. John Martin, was directed, in company with Geo. Rose, to pursue the
prisoners; and at Black Brook, they overtook the prisoners. DR. BROWN here took an objection to the
indictment; and contended that the brass pipe in question was a fixture to the freehold, being screwed
on the pipe which passed through the wall. The objection was allowed to be good by the Court; and the
prisoners were acquitted.
The indictment was amended, and the prisoners were again arraigned, when it came out that one of the
prisoners presented a pistol, loaded with ball, and snapped it. (fortunately the percussion cap had
dropped off) at Martin, the man who first came up with them. They were, after a most obstinate
resistance, secured, and the gas pipe found on the person of Longshaw. The jury found the prisoner
guilty. The Chairman said, this case was one of the most serious that ever came before a Quarter
Sessions. The prisoners were sentenced to be transported for seven years.
