1867 14 Dec - Lancaster Gazette - INGLETON - CATTLE STRAYING - At the West Riding Magistrates’ Room, Ingleton,
on the 6th December before J. Farrer and E.M. Fenwick, Esqs., Isaac Hully, of Bentham, cattle dealer,
was summoned for allowing his cattle to stray on the highway in the township of Bentham, on the 28th
ult. Defendant appeared and denied the offence. P.C. Toulmin proved that on the 28th ult., about 11
a.m., he found three heifers, the property of the defendant, straying on the highway, and he put them into
the field. The fences are bad. Several complaints have been made against him. Fined 6d and costs2s.2d.

Manchester, by the Rev. William Huntingdon, M.A., rector. Isaac Hully, Esq., of Bentham, Yorkshire, to
Katherine, youngest daughter of the late William Phillips, Esq., of Eccles.

1868 04 Apr - Lancaster Gazette - HORNBY PETTY SESSIONS - YESTERDAY - (Before T. Greene, J. Thomson, and
North North, Esq.) - EXTRAORDINARY ASSAULT CASE.
A case was heard at these sessions which excited considerable interest in the neighbourhood. At last
Wray fair five of the gamekeepers attached to the Hornby Castle estate were armed with sticks and
demanded toll, and much popular feeling was demonstrated. On the occasion of a refusal to pay the toll
demanded an assault was committed, and the crowd vented their indignation on the keepers. The
present case was an action arising out of this circumstance.
John Easterby and Isaac Hully, two respectable men, were charged with having assaulted Robert
Winder, a gamekeeper in the employ of John Foster, Esq., of Hornby Castle, whilst in the execution of
his duty of collecting toll on the 25th of February at Wray fair. Mr. W. Sharp appeared for the prosecution,
and Mr. C. T. Clark for the defendants.
Mr. Sharp, having opened the case, called the following evidence:-
Robert Winder said - He was in the employ of Mr. Foster, and was at Wray fair on the 25th February. He
was collecting toll. Two men, named Eaton and Barrett, passed with two cows and objected to pay toll,
and he (witness) stopped the cows and put them into a garden; but they broke out, and he then put them
into a shippon and gave them some hay. A crowd came in about an hour and he went through the
house to the back yard, when he found Easterby and Hully with the cows. There was a gate in the back
yard. Hully took hold of the gate and tried to open it, and Easterby came and got hold of the other gate
and seized witness with one hand and the gate with the other and threw witness down. Witness got up
and followed the cattle. Whilst he was on the ground he was struck with both sticks and flats, but he
could not tell who struck; but both Easterby and Hully were there. Witness followed the cows, but his
heels were knocked up but he did not know by whom; but Easterby struck his heels once.
Cross-examined.- Witness said he was quite sober, and did not challenge any one out to fight. He
admitted striking Thomas Nielson, who had hold of his arms. Witness asked for the toll, but Barrett said
he would not pay it. He did not strike the cows or abuse them, he might just hit them on the hocks. He
did not know what the other keepers might do. He did not know that a deposit of £10 was offered to
abide the question of toll. He believed they wanted to take the cows to the train. Defendants each
opened the gates. He did not strike Easterby over the arm, but Easterby got hold of him by the whiskers.
Re-examined - He said it was the rule to stop cows when toll was refused. John Atkinson said he was
assisting Winder to collect tolls. Eaton and Barrett refused to pay, and they seized two cows and put the
into a barn. Easton and Barrett brought a crowd and Hully got hold of one gate and Easterby the other.
Easterby got hold of Winder by the whiskers and the cows were taken. Easterby and Hully had Winder,
down on the road and held him. Witness went up to them and asked them if they were going to murder
Winder.
John Hoggarth, William Seed, and James Pickering corroborated this evidence, and added that a great
many struck Winder with sticks.
Mr. Clark, for the defence, said he would not enter into the question of toll and would pronounce no
opinion on its legality, but there are two ways of collecting toll, one in a civil way and one in a rough way,
and in this case it appeared to him that the rough way had been chosen. No board was placed showing
what tolls were to be taken, and people were at a loss to know what the toll was demanded for. No such
thing was heard of in the times of Mr. Dawson and Mr. Wright, and it was certainly a new way to collect
tolls for five keepers to go armed with large sticks to demand it.
Winder did not appear to him to be quite sober at the time and had admitted injuring a young man on
Hornby Bridge just after. He (Mr. Clark) was quite sure Mr. Foster would not encourage such conduct,
and would dismiss any keeper guilty of such misconduct. The real facts of the case were, that Mr.
Easterby and Mr. Hully had sold cattle to Mr. Barrett and Mr. Eaton, and they wanted to go off by the
quarter past one train. Mr. Barrett did not know anything about the toll, but he offered to deposit £10 with
any respectable person to meet it, but even this did not satisfy these rough keepers. They seized the two
cows which was clearly an illegal act. They prevented Mr. Barrett from taking them to the station, and
this naturally caused great indignation amongst the people assembled. Mr. Hully the opened one gate
and Winder came forward, but the was no evidence that Hully ever struck Winder or anybody else, and Winder never said so. Mr. Easterby was at the other end and whilst at the gate Winder struck him a
violent blow on the arm. Easterby then , it was true, laid hold of Winder’s arm to protect himself, but he
neither struck him or knocked him down. The keepers then savagely attacked the cattle brutally with
their staves. Mr. Easterby and Mr. Hully had a perfect right to use al reasonable means and force to get
the cattle to the station. It was false that either of the defendants touched Winder, and both of them
would positively deny it. The bench, on the evidence of Winder and Atkinson must come to the
conclusion that they were not speaking the truth. Winder was said to be the injured person, but not one
half of it had been proved. Mr. Clark felt satisfied that the Bench would rather take the evidence of two
respectable men like the defendants, both men of substance and respected by their neighbours, and
believing them they must dismiss the case, a decision which would meet the approval of all who heard
it. As to Mr. Hully, ther was no evidence against him at all, and against Easterby there was only the
laying hold of Winder’s beard which ws simply done in self-defence.
He than called: -
Wm. Titterington who said he lived at Bentham, and was at Wray fair, and was present at the gates. He
saw Winder and Atkinson there and they had their coast off and sticks in their hands. Toll was demanded
of Barrett but he refused, and the keeper took two cows. He saw the keepers strike the cows shamefully.
Barrett offered a deposit of £10 to abide the question of toll, and gave his name and address. Hully was
at one gate and Easterby at the other. When Easterby seized the gate Winder struck him over the arm,
and Easterby got hold of Winder’s whiskers. He did not see Easterby strike Winder.
Cross-examined - Witness did not see Easterby knock Winder down, for there was a great row. Winder
struck Easterby several times. Both Atkinson and Winder struck.Christopher Wilcock said he was
present and heard Barrett tell the keepers that he wanted to take the cows to the station, and would
leave a deposit of £10 in the landlord’s hands. Winder struck Easterby several times and also struck the
cattle.
Cross-examined - Witness said Winder was trying to keep the gates shut. Winder and Easterby struck
as often as they could. Winder and Atkinson must have heard the offer of £10. It was made before the
gates were opened.
Isaac Hully was called, and he said he heard Barrett make the offer of a deposit of £10 several times. He
denied he touched Winder, or that Easterby did. There were some 50 or 60 people there.
Cross-examined - He could not swear that Easterby did not strike Winder, but he saw him hold of his
whiskers. Winder was down on the road, and there were two or three on top of him.
John Easterby, of Betty-hill, said he sold the cattle to Easton and heard Barrett offer a deposit of £10 as a
guarantee of payment of the toll. Winder struck witness with a big stick, and witness then seized him by
the whiskers. There were a great many people there. He did not see Winder on the ground. Winder
struck him, when he took hold of the gate, some half-dozen times; but he (witness) did not throw Winder
down, nor did he use any sticks. His arm was black for a fortnight.
Mr. Sharp having replied on the case, the Bench dismissed the case against Hully and fined Easterby
1s. and costs.

1874 18 Jul - Lancaster Gazette - LOCAL INTELLIGENCE - TROTTING MATCH AT HORNBY -
A trotting match which created a considerable amount of interest and excitement, came off at Hornby on
Wednesday last. It was between two ponies belonging respectively to Mr. Anthony Orr and Mr. Isaac
Hully, both farmers in the district. Mr. Orr’s “Maggy” was the favourite so far as betting was concerned,
and the “Brown Duchess,” belonging to Mr. Hully, also found a great many supporters.
The start was made at one o’clock opposite the Royal Oak , where a large number of persons were
assembled. “Maggy” took up the lead, but the “Brown Duchess” soon took up the running and was
rapidly gaining ground when she broke the trot, and Mr. Hully had to turn round. The “Duchess”
repeated this performance a second time, the result being that at the finish she came in nearly half a
minute after “Maggy,” the rider of the latter being loudly applauded on passing the running post. The
match was for £5 a side. Time 6 minutes 10 seconds.

1875 30 Jan - Lancaster Gazette - BREACH OF CATTLE PLAGUE REGULATIONS . Isaac Hully of Chapel House, was
charged on Thursday, before Messrs. Saunders, Moore, and Hornby, at Kirkby Lonsdale with not
reporting to the police that he had a bull in his possession suffering from the foot and mouth disease.
Mr. Tilly represented the defendant. The Bench inflicted a penalty of £5 and costs £2.10s.

1875 20 Nov - Lancaster Gazette - PETTY SESSIONS TUESDAY -
Isaac Hully, a farmer at Chapel House, near Bentham, was also charged under the same Act, with
having on the 2nd inst. (Stot Tuesday Fair) exposed for sale at Settle, a number of lambs said to be
suffering from the foot and mouth disease. Mr Sudell was again called in support of the information, and
Mr. Welch, veterinary surgeon, Kirkby Lonsdale, and Mr. Anderton, veterinary surgeon, Skipton, were
called to the defence, and both agreed that the animals were not suffering from the foot and mouth
disease but from foot rot. This case was also dismissed, but without costs. Mr. Berry appeared for the
defence.

1877 Oct 13 - Preston Guardian - District News - Lancaster - A Farmer’s Dispute. At the Town Hall, on Thursday, John
Butterfield was charged with assaulting Isaac Hully. The parties are well-known cattle dealers, and it
seems that Mr Hully had been bargaining in the fair on Wednesday with defendant’s son-in-law
respecting a heifer. Defendant, on being made aware of it, said Mr Hully should not have the animal,
and when he attempted to put his mark upon it defendant struck him a violent blow on the nose with an
umbrella. As there were mitigating circumstances, the Bench inflicted a nominal penalty of 2s.6d., and
£1 4s.costs

1883 23 Jun - Lancaster Gazette - HORNBY PETTY SESSIONS - WEDNESDAY - Before James homson, Esq.,

Kennedy. PROSECUTION OF FARMERS FOR EVADING CATTLE RESTRICTIONS.
Several farmers residing in the neighbourhood were summoned for infringing the regulations of an
order of the Privy Council entitled “The Infected Districts and Markets and Fairs Order, 1883.” Isaac Hully
(plus 2 more) were each charged with selling cattle at Whoop Hall on the 24th of May, and similar
evidence to that in the former cases was given. An information had been laid against Wm. Chester,
salesman for Mr. Hully, but acting on the advice of the Bench, Supt. Moss withdrew the information.

1884 May 28 - Leeds Mercury - Sales by Auction - By Mr Richard Turner, at the Royal Oak Hotel, Bentham, on Tuesday,
the Tenth June, 1884, at 2:30 p.m., in the following or such other lots as may be determined upon, and
subject to such conditions as may be then and there produced.
All those Two Enclosures of Valuable Accommodation Land, called Borrens and Croft, together with the
Three Cottages and Gardens, containing altogether, 3a, 3r, 3p. in statute measure, or thereabouts, are
situated at Lower Bentham aforesaid, in the respective occupations of Mr Isaac Hully and others as
tenants.

1891 Jul 25 - Preston Guardian - Cows 16 Hours Unmilked. Isaac Hulley, a cattle dealer, of Arkholme, near Kendal,
was summoned at the Borough Police-court, yesterday for cruelty to a couple of cows. Inspector Ghent,
of the R.S.P.C.A., deposed to being on duty in the Cattle market, Preston, on July 11, at 9.30 morning,
when he saw two cows belonging to the defendant apparently in distress. He examined them, and
found that they were suffering from over pressure with milk. He called Mr Hulley's attention to it, and he
said they were milked about six o'clock the previous evening, so that they had gone nearly 16 hours,
without being milked. Each cow had recently calved, and they should not in any case go over 12 hours.
One cow was not milked until an hour after his first perceiving the cruelty. The Chairman said it was far
too common practice with farmers, and defendant would be fined 10s and costs, in default, seven days
with hard labour.

The cattle, which were judged by Mr. A. Cleasby, of Sedbergh, and Mr. Isaac Hully, of Lea, only
numbered 66, against 95 last year, a decrease that was probably accounted for by the fact that
most farmers were too busy harvesting to prepare stock for show.

the death of Mr Henry Nutton, 42, butcher and auctioneer, Colne. The evidence showed that on the 1st
inst., a man named Harry Bland was instructed By the landlord of the Swan Hotel, to drive the
deceased, Mr Hully, auctioneer, Barnoldswick, and Mr William Crabtree, White Syke Farm, near
Foulbridge, to value Mr Crabtree’s farm. (etc) A verdict of "accidental death" was returned, with a
representation to the Colne Local Board to remove the stone.
