1852 20 Oct - Manchester Times Rochdale - assaulting a gamekeeper. On Friday, at the petty sessions, John Hulley
was charged with having on the previous Friday, committed a serious assault upon Joseph Milnes,
underlooker, in the employ of James Dearden, Esq Lord of the Manor of Rochdale. It appeared that the
gamekeeper was attending to his duties on the Saddleworth side of the moors when he discovered a
person with a gun in his hand. He commenced a pursuit, and afterwards another person, whom he
believed to be the person charged came up and commenced an assault by striking Milne's with the barrel
of a gun, by which two bones on the back of his hand were broken. The other man, who is not yet
apprehended, fired at the complainant.
A witness was examined proving that Hulley was near the place about the time of the occurrence, and he
was seen to throw his coat upon the ground, which was to some extent, confirmatory of the statement of
the complainant, who had stated that the man who struck him was without coat. It appeared that the two
men seen on the moors by the gamekeeper, had blacked their faces for purpose of preventing
themselves from being identified. The defendant did not deny the statements made against him. The
magistrates inflicted a penalty of two pounds and costs, amounting in the aggregate to the sum of four
pounds 19 shillings and 8d.

1852 24 Dec - Huddersfield Chronicle and West Yorkshire Advertiser - SADDLEWORTH - MORE GAME CASES. John
Hulley also charged William Schofield and Thomas Holroyd, with assaulting him on Monday, the 20th
inst. He went on that day to "Hind-hill," a piece of Moor-lane, on Friar-mere, for the purposes as he said
to "shoot snipe." The defendants are gamekeepers in the employ of Mr Dowes, of Marsden, whose
common land joins up to Friar mere common land. On the morning in question, defendants were up
the boundary line, and hearing the report of a gun, after a little while came upon the complainant, who
was sat upon the ground. The defendants suspected that the complainant had been infringing on the
game laws, and proceeded to search his pockets, hence the charge of assault. The case was
dismissed. We understand that defendants has since issued a summons against complainant for an
infringement of the Game Laws.

1853 08 Jan - Huddersfield Chronicle and West Yorkshire Advertiser - SADDLEWORTH GAME CASE -- At the petty
sessions at Uppermill, on Wednesday last, before the Rev. R. Whitelock and J. H. Whitehead, Esq, John
Hulley, the younger, was summoned to appear on the information of Mr John Dowse, of Marsden, corn
miller, on two informations, viz., one challenging the said John Hulley with having game in his
possession on the 20th of December last, to which, a bird called grouse; and the other trespassing in
pursuit of game on the Friar Mere Moors, at a place called Back of Hind Hill, on the said 20th December.
Mr Dowse was only the nominal informant, but appeared in court, represented by Mr Clough, of
Huddersfield, as to the legal points in the case, and by two of his game watchers named William
Schofield and Joshua Holroyd. Mr Clough opened case at great length, and called Schofield, who
proved finding a grouses in Hulley's pocket, warm, and bleeding, on the morning of the 20th ultimo. The
magistrates fined him 10s., and costs, which was paid. The trespass in pursuit of game case was
adjourned 14 days, to allow Hulley to produce before the magistrates any person or persons who had
given him leave and licence to shoot game on the Friar Mere Moors. Hulley produced a written
document from H. Gartside, Esq., authorising him to shoot over the unenclosed common lands on Friar
Mere, he having an eighth share of the said lands; also another document signed by a Henry Whitehead,
giving him the authority to shoot on the Friar Mere Moors, but Mr Clough said that he would much rather
that persons were produced than take the written documents. The case was consequently adjourned 14
days.

1853 05 Feb - Huddersfield Chronicle and West Yorkshire Advertiser - SADDLEWORTH - TREPASS IN PURSUIT OF
GAME - John Hulley, the younger, was charged by Mr.Dowse, of Marsden, with trespass in pursuit of
game on the Friar-mere Moors, on the 20th of December last. Mr Clough, of the firm of Clough and
Bantoft, of Huddersfield, conducted the case for the complainant; and the charge was laid under 1 and 2
William IV., 13., sec. 30. In this case, though the complainant had no right upon the land in question, he
took advantage of the privilege which the law affords, and turned common informer. The case came on
for hearing a month ago, and the defendant then alleged that several parties, joint owners of the moor-
land in question, had given him "leave and licence." to shoot over them, hence the case was adjourned
to enable him to bring forward evidence in proof thereof. The facts of the case are already in
possession of our readers, being simply these, that on the 20th of December Hulley was seen by two of
the complainant's gamekeepers at the back of Hind-hill, with a gun in his hand, and a dead moor game
in his possession. The defendant failed to prove to the satisfaction of the bench that he was there by the
"leave and licence" of parties who were joint owners of the land, and was muleted in the penalty of 5s.,
and 9s. in expenses.

1853 27 Aug - Huddersfield Chronicle and West Yorkshire Advertiser - SADDLEWORTH - GAME CASE - on
Wednesday last, the Petty Sessions, before James Lees, Esq, Rev. R. Whitelock, clerk, James.
Heywood Whitehead, and Thomas Robinson, Esqrs., a case which excited considerable interest in this
parish came on for hearing, wherein Mr John Dowse, of Marsden, was the nominal complainant, and
John Hulley, the younger, of Delph, was the defendant. Mr Clough, of Huddersfield, solicitor, opened
the case, and called William Bullhouse, gamekeeper to Mr Dowse, who stated that on the 12th instant
he saw the defendant at a place called Northern Rochers, on Castle Shaw Moor. Defendant had a gun
and said that he had shot a bird which he could not find. He demanded defendant's certificate, which he
produced, and defendant then demanded his certificate. Mr Ascroft, of Oldham, solicitor, admitted that
the defendant was on Castle Shaw Moor on the day named, by the leave of a number of joint owners of
the said moor. He called Mr Henry Whitehead, of Friarmere, the owner of one fourteenth part of Castle
Shaw Moor, Mr John Kershaw, of Paradise, a joint owner of the unenclosed common land, and Mr James
Shaw, another owner, said they had given the defendant authority to shoot over the said common land
called Castle Shaw Moor. The bench were unanimously of opinion that the case must be dismissed.

1854 14 Oct - Huddersfield Chronicle and West Yorkshire Advertiser - SADDLEWORTH - TRESPASS IN PURSUIT OF
GAME. John Dowse, Esq., charged John Hulley, jun., with trespassing in pursuit of game on
Ravenslades allotment of common land, upon Friarmere, on the 15th of ult. Mr Lawton, of Delph,
appeared for the defendant, and Mr Clough, of Huddersfield, for the complainant. Mr Lawton applied for
the case to be adjourned a fortnight, in consequence of his client only receiving the summons, late on
Monday evening, which had not given him time to prepare his defence, and which was one of leave and
licence to shoot over the common land in question. Mr Clough opposed the application, but after some
consideration, the bench adjourned the hearing of the case for a fortnight, on defendant agreeing that the
cost of the witnesses for that day should be costs in the case. This very difficult question of Castleshaw
Moors is a den to be raised and argued. It appears that the said moor have, for a number of years back,
being considered public property. As regards the game there on; and the common in question never
having been divided or awarded, the owners of pasturage claim the right of game, and they are the
persons who are said to have given defendant Hulley leave and license to shoot over the said moor

1854 28 Oct - Huddersfield Chronicle and West Yorkshire Advertiser - SADDLEWORTH - TRESPASS IN PURSUIT OF
GAME. On Wednesday last at the petty sessions, before John Buckley, James Heywood Whitehead, and
Thomas Robinson, Esqs., John Hulley, the younger, of Delph, was charged on the information of William
Schofield, of Marsden, game watcher to Mr Dowse, with having on the 15th day of September last,
trespassed in pursuit of game on a plot of common land called Ravenslades Allotment. Mr Clough, of
Huddersfield, appeared for the complainant, and Mr John Lord, of Ashton-under-Lyne, for the defendant.
It appeared from the evidence that Ravenslades Allotment was the property of Mr Lloyd, of Liverpool, and
that Mr Dowse rented it from his steward, Mr Blackburn. That such allotment was separated from
Castleshaw-moor by a cut ditch on one side and clods set up on the other as boundary marks; and that
defendant, Hulley, had often been warned off the said allotment before. For the defence, a number of
witnesses were called, who proved that they had given defendant leave and licence to shoot over
Castleshaw-moor; but, on cross-examination by Mr Clough, they all stated that they did not know
where Ravenslades Allotment was. The magistrates fined Hully 40s., and costs, and in default of
immediate payment he was committed to the House of Correction at Wakefield to hard labour for one
calendar month. Hulley was also charged with trespassing in pursuit of game on common land is at
Diggle Edge, the property of Messrs., Broadbent, Bradbury, and Broadbent, on the 9th day of October
instant, and fined in a second penalty of 40s., and costs, and in default of immediate payment of
the same, he was committed for one calendar month to Wakefield House of Correction on the second
conviction -- such term of imprisonment to commence at the expiration of the first.

1855 20 Oct - Halifax Courier - MAGISTRATES’ OFFICE. WARD’S END - SATURDAY - IMPORTANT GAME CASE.
JOSEPH BUCKLEY, WILLIAM KNOTT, DENNIS BARRETT, JOHN HULLEY, junr., JAMES LACKENBY,
and JAMES HULLEY were charged with being, with other persons, to the number five and more, in
pursuit of game upon Rishworth Moor, the property of the Earl of Scarborough, in the occupation of Sir
John Lister Kaye, on the 24th of September.(no evidence to identify the Hulleys in this case except that
“John Hulley had a right of shooting on Castle Shaw Moor; John Hulley lived at Saddleworth, two or three
miles from the residence of witness i.e. Thomas Brierley; the two Hulleys had been convicted for
poaching. The John Hulley junr. is probably John Hulley 1819-1889 and the James Hulley is his elder
brother James 1816-1885.

1959 12 Nov - Huddersfield Chronicle and West Yorkshire Advertiser - Magistrates in Petty Sessions. Magistrates’
Court, Saturday, November 5, On the bench: G. Armitage, John Haigh, ,Wm. Willans, and L.R, Starkey,
Esqs. TRESPASS - John Hulley was charged with committing a trespass on land in the occupation of
Mr John Dowse, Marsden, on the 28th ult. Mr Mills appeared on behalf of complainant. William
Schofield, gamekeeper, said that on the day named defendant was on the road going to Buckstones,
and persisted in stopping and making great noises to raise the birds. He was cautioned by Schofield,
who, in about an hour afterwards again saw the defendant on the moor at Buckstones, making noises.
Witness asked him what he was doing? Defendant replied, "nothing." Defendant was fined £1, and 16s.
expenses; in default of payment to be committed to Wakefield House of Correction for two months.

1865 28 Oct - Huddersfield Chronicle and West Yorkshire Advertiser - Magistrates in Petty Sessions TRESPASS IN
SEARCH OF GAME - John Hulley, an old offender, was charged under the Game Act with trespassing in
the daytime on land at Marsden, in the occupation of Mr John Edward Dowse, for the purpose of taking
game. Mr Clough stated the case. Benjamin Schofield, a keeper for Mr Dowse, was on the moors near
Buckstones on the forenoon of the 13th inst. And saw the defendant go up a "gruft” on the "hassocks”
"calling" the birds. After going a short distance a cock-bird was started; and defendant fired both barrels
of his gun, killed the bird, which fell on the moor. Defendant went and "gathered" It; and the keeper went
up to him.
Defendant said "Thou will not bring me up for this Ben, nor send me no papper (summons)." The
keeper assured him that he would be summoned, whereupon the defendant said. "If you do it will be
worse for you." The defendant did not deny being on the moors, but asserted that he neither fired at nor
killed any birds. The defendant had been convicted both at Huddersfield and Saddleworth, upwards of
20 times for offences against the Game Act. The Bench inflicted the full benefit penalty of 40s. and costs
14s. 6d., or in default two months in prison. Mr Clough said he believed the defendant had a certificate,
but having been convicted it became null and void, and that if he went on the moor again under that
certificate he would be liable to other penalties.

1866 13 Jan - Huddersfield Chronicle and West Yorkshire Advertiser - SADDLEWORTH - Petty Sessions Wednesday
January 10th. On the Bench: Jas. Lees, J.H. Whitehead, and F.F. Whitehead Esqs. - KILLING GROUSE
OUT OF SEASON - John Hulley, of Delph, was charged on the information of Benjamin Schofield,
Assistant-gamekeeper of John Edward Dowse, Esq., with having on the 21st ult. unlawfully killed grouse
out of season. The complainant stated, that at about nine o'clock in the forenoon of the day named he
saw the defendant ranging Cudworth pasture with a gun. A covey of grouse or red game got up, and
defendant fired his gun at them and killed one bird, which he gathered and put into his pocket. Witness
followed defendant who ran away to a place called Broadhead; he entered a house there, and fastened
the door.
Witness knew defendant well and spoke to him, but did not get nearer to him than seven yards. Mr
Clough, of Huddersfield, appeared for complainant, and stated that defendant had been convicted of
trespassing in pursuit of game about three months ago, and had forfeited his licence; as under the present
Game Certificate Act any licence to kill the game became null and void after the person holding it was
convicted, he therefore had no licence at the time he was in pursuit of game on the day named. The
defendant was fined £1 and costs.

1869 02 Oct - Huddersfield Chronicle and West Yorkshire Advertiser - MARSDEN - CHARGE OF TRESPASSING ON
MARSDEN MOOR - QUESTION OF RIGHT. At the Court House, Huddersfield, on Tuesday, before G.
Armitage, Wm. Wrigley, and Joseph Norton, Esqs, a charge of trespassing in pursuit of game was
preferred against John Hulley. Mr S. LEaroyd appeared on behalf of the complainants; and Mr John
Sykes defended. Mr Learoyd, in opening the case, said the case stood adjourned from the previous
Tuesday, in order that Mr Sykes's witnesses might attend. Defendant was charged with trespassing in
pursuit of game on the moors in Marston-in-Huddersfield, the shooting over which had been taken by Mr
Buckley and others. On that morning, not at a very sporting like hour, shortly after four o'clock, the keeper
was out, and saw Hulley shoot. He followed, and saw the defendant pick up a bird, and walk away with it.
Joseph Shaw, keeper, in the employ of Messrs Buckley, was called, but Mr Sykes said he did not dispute
the shooting. The witness stated that the Marsden moors adjoined the Saddleworth moors, and that the
boundary stone was below where the defendant shot better than 100 yards. Mr Armitage: You swear that
he shot and picked up the bird on your employer's ground? Witness: Yes. In cross-examination, witness
said, when he went up to him, the defendant said. "Bill o’ Captain’s has shot there;" “Yes” (said
witness) “And thou has shot there, and thou’lt have to pay for it”. Witness had been a keeper, seven
months, but had shot on the moors 30 years.
Mr Sykes, in defence, raised a question on right. The magistrates, he urged, could not try the boundary of
a manor, it being a maxim of law that, where a question of title arose, the jurisdiction of the magistrates
was ousted. He should call evidence to show that the ground on which the defendant discharged the shot
was in Saddleworth, and not in Marsden. Mr Thomas Riley, tailor, of Mossley, formerly for many years
gamekeeper in service of Mr G. Armitage and brothers, was called to give evidence with regard to the
position of the boundary line, but objection was taken; and it gave rise to a lengthy discussion as whether
the question of right was involved in the case or not. Mr. Armitage remarked that, if when a person
trespassed, a question of right could be set up in defence, no gentleman would be safe. The witness (Mr.
Riley) said he had known the moors forty-five years. The boundary stone had been removed three times;
but, the place pointed out by the keeper as that in which he saw the defendant was 200 yards in
Saddleworth. Mr. Armitage - Well, then, there is a dispute with regard to the boundary. Riley: I never
knew my masters exercise any right where this bird was shot.
Mr. Armitage: It is, I see now, decidedly a dispute with regard to the boundary. Riley: It is 200 yards in
Saddleworth according to the water boundary. After the advocates had argued the point or whether there
was or not a question of title in the case, Mr. Armitage said he had known Riley 30 years, and he was a
very respectable man.
There was a disputed right, and the case would be discharged of want of jurisdiction.

1871 26 Aug - Huddersfield Chronicle - ROBBERY BY A LODGER - John Hully, a tramping tailor, who had been
employed in the neighbourhood for three or four months, and lodged with Mrs. Mills, of Uppermill, left
his lodgings on Tuesday, the 15th inst., and returned on the Thursday following, when he went upstairs,
in the absence of Mrs. Mills, and fastened himself in one of the bedrooms. Mrs. Mills, ascertaining that
he was upstairs, got assistance and turned him out of the house. Soon afterwards it was discovered that
he had broken open a box, belonging to Robert Buckley, another lodger, and stolen therefrom one gold-
plated Albert guard, three gold-plated shirt studs, one silk necktie, one pocket knife, one tooth picker,
and 6s. 8d in money. He was apprehended at Greenfield station, about half-past four o’clock, soon after
the robbery was discovered, By Serjt Peters, who found the stolen property upon him. He was brought
before the Magistrates on Wednesday, and committed for one month.

SESSIONS. Offences against the Factory Act. On Wednesday, the 9th instant,
Messrs Schofield and Broadbent, of New Delph, cotton spinners, were cited before
James Heywood Whitehead and Thomas Robinson, Esqs., charged by Mr Edward
Davies, sub-Inspector of factories, with having, on the 25th day of July last, employed
Ann Hulley, Sarah Wrigley, Betty Schofield, Alice Hulley, and Elizabeth Bright,
females above the age of 13 years, after the hour of six o'clock in the evening of the
said day. Mr Broadbent pleaded guilty, and a fine of £3 in the first case and £1 in the
other four cases was inflicted, which, together with the costs, amounted to upwards
of £10. Hard Case under the Factory Act. Mr George Broadbent, of Pringle Mill,
near Delph, was charged by the aforesaid sub-Inspector, with employing one Lucy
Hulley, a child under the age of 13 years, before the hour of 12 o'clock at noon, and
after the hour of one o'clock in the afternoon, of the 24th day of July last. Mr
Broadbent, in explanation of the offence, stated that one of his slubbers had three
pieceners at the time the offence took place, namely, one full-time and two short
timers; that on the forenoon of the 24th ult. the full time piecener fell down in a fit,
and had to be removed home, and had not been able to attend to her work since.
The slubber could not procure another piecener to fill her place, so he ordered the
short time piecener who had worked in the forenoon of that day to go again in the
afternoon, which she did, and the inspector found her working when she ought to
have been at school. After this explanation the bench inflicted the lowest penalty
allowed by law, namely, £2 and costs.

1853 28 Sep - The Manchester Guardian: ROCHDALE AND MIDDLETON - POACHING
On Monday last, at the petty sessions held at Rochdale, James Hulley, of Saddleworth was charged with
poaching, by shooting grouse on the Blackstone Edge Moors. The complainant was Joseph Mills,
gamekeeper, in the employ of James Dearden, Esq. lord of the manor of Rochdale. the charge was
proved, and a charge of £5 and costs was inflicted, and in default of payment the defendant was
committed to the house of correction for three months.

1862 20 Jul - died at Staley, Saddleworth

1862 Jul 22 - Leeds Mercury - Fatal Gun Accident (From our Correspondent.) A fatal gun accident took place in
Dukinfield, Cheshire, on Sunday afternoon. It seems that Mr Andrew Ashton, farmer, Fir Trees,
Cheetham Hill-road, Dukinfield, is in the habit of keeping several guns and pistols in his house. His
nephew, Charles Bardsley, works at Mr Taylors, of Marsden, coming home to his uncle's only on
Sundays. He had invited a young man named John Brierley, a clogger, residing at Marsden, to come
over to his uncle's house in Dukinfield and inspect one of the guns. On Sunday, being Stalybridge
wakes, Brierley and several companions accordingly, came to Dukinfield, bringing with them a young
man, named James Hulley, a hand-loom weaver, from Mossley Bottoms. They got to Mr Ashton’s about
four o'clock in the afternoon, and were met by the nephew, Charles Bardsley. Hulley sat himself down on
a kind of squab, or sofa, and Bardsley went to draw his friends some beer. Brierley then took in his hand
the gun he had come to look at, placing, as is usual, his thumb on the lock; which a young man, named
Daniel Hindeson, a smith, from Marsden, observing, told Brierley to mind his own business, meaning he
ought not to meddle with property in a stranger's house. Brierley on that turned his head towards
Hineson and replied “Find it out," and immediately the gun went off, and its contents were lodged in the
right-hand side of Hulley's neck, and he was blown from his seat. Hulley never spoke again, and was
pronounced dead when a surgeon got to him, which was in less than 10 minutes after he had entered Mr
Ashton's house. The deceased was unmarried, and was about 28 years of age. The body was removed
to the Lodge Hotel, to await the inquest. Bardsley says he did not know the gun was loaded, and Brierley
could have no knowledge that it was, so, but we believe it is one which Mr Ashton keeps for the protection
of his house, and has regularly in his bed room. Brierley suffered great agony of mind after the distressing
accident.

1862 Jul 22 - Liverpool Mercury Local Intelligence - James Hulley, a hand-weaver, was killed at Dukinfield, Cheshire,
on Sunday, by the accidental discharge of a gun, which was being examined by one of his companions.
(Similar reports in the Manchester Guardian and Glasgow Herald)

1862 Jul 22 - Leeds Mercury - Local and General - The Fatal Gun Accident at Dukinfield.
The inquest on James Hulley, whom we yesterday reported to have been killed by a gun accidentally
going off at a farmhouse in Dukinfield, was held yesterday before Mr William Johnson coroner. The
deceased was 32 years of age. The facts were as previously stated. John Brierley, a clogger, Marsden,
the man who was handling the gun when it went off, was very much affected when examined. He had
had considerable experience with guns. The jury after hearing the evidence was of opinion that the gun
had been at full cock, with a cap on the nipple. Brierley was considered unblameable, and a verdict of
"Accidental death" was returned.
