Notes

210. Sarah Hulley

1804 - born at Luzley, near Ashton under Lyne. No birth or baptismal record exists for this person. The birth year

next youngest and elder siblings of Sarah were born at Luzley, it has been assumed that she was born
there also.

James and Sarah had a child called Edward who was alive in 1860 so they were not the parents of this Edward.

241. Elkanah Hulley

1790 born at Ashton under Lyne (sorce- 1841, 1851 censuses -see below)

Note: No birth or baptismal record has been found for this person. A careful analysis of
births in Ashton under Lyne during the period 1780 to 1800 has been made,
together with a name analysis of males. It has been concluded that Elkanah was
the 10th child of Robert and Sarah (nee Hyde). Robert was the illegitimate son
of Mary, who married Joseph Wild 4 years after the birth of Robert. Elkanah's first
male child was named Joseph, presumably after the husband of his mother, who
could also have been his (Elkanah's) father.

1857 15 Aug - Manchester Courier and Lancashire General Advertiser. SUICIDE - An inquest was held at the house of
Mr. William Kershaw, the Old Ship Inn, Wellington-street, on Thursday evening, before Mr. Rutter,
county coroner touching the death of Elkanah Hulley aged 68 years of Peel street. The deceased was
found hanging at his bedside on Thursday morning, about half-past seven o'clock, by his daughter, and
was cut down by Constable Dunn, but life was extinct. He had had a paralytic stroke about eight weeks
ago, and had since then been afflicted in his mind, having on several occasions called for knives to
destroy himself. Every attention had been paid to him by his son-in-law and daughter, and Dr. Lees had
regularly attended him; and had often cautiooned his friends to be careful that he did not destroy him-
self. After the coroner and jury had stated their impression that it would have been better if the deceased
had been put into some a verdict in accordance with the facts was returned.

Name Robert Hully
When Tried 1829 April Sessions
Offence Larceny
Convicted & Sentenced
Imprisonment 7 Years

1829 Feb 7 - Manchester Times - Ashton Petty Sessions (Before W. Astley, Esq and Captain Clark,. N..) Wednesday,
Feb 4. John Lowe and Robert Hulley, were brought up under the following circumstances: -- Mr Samuel
Chapman, of Hurst, stated that on the evening of the 19th of December last, there was in his warehouse
role number of shawls and a considerable quantity of Bolton quilting, and flannel; that the premises were
secured in the usual manner, and that in the morning, one of the windows was found open, and a great
quantity of the goods had disappeared. (The robbery was noticed in our paper of the 26th of Dec.) The
Bolton quilting, and flannel, with upwards of eight yards of stuff, for pantaloons were produced in court,
and were clearly identified by Mr Chapman, as his property. Two witnesses were then called, who
confirmed the truth of the above statement. John Standring, the constable, said that he had, in
consequence of some previous information, searched the prisoners’ houses, and had found the goods
now produced. Lowe said he had purchased the black stuff, and found the other. Hulley declared that
Howe had brought the quilting and flannel, to his house on Saturday evening last, and said he would
fetch them back again in two but has to carry three days, and pay him the money, which he owed him.
Both of the prisoners were committed to the New Bailey for trial.

To the Right Hon.ble Visct. Melbourne
His Majesty's Secty of State for the Home department
My Lord
I have been informed that a petition has or will be presented to your Lordship praying for the Release of
a convict of the name of Robert Hully. Hully was convicted at the Apl Sessions in Manchester 1829 with
another person of the name of Lowe who was sentenced a like with Hully to seven years transportation
the both was convicted as thieves the neither of them offered any evidence on the Trial, and as Hully
had lately before been in my servitude as a Spinner and was well acquainted with the premises from
which the goods were stolen, there is no doubt in my mind but he was accessory to the Robbery, or at
least that he had a Guilty Knowledge of other persons concerned, because the Robbery took place at
such a time with the greatest difficulty in conveying the property away, one person could not have
committed it Single Handed. Other Robberies of Minor import took place a litle prior and subsequent to
mine for observe Hully and Lowe when not taken up until some weeks after my premises where broken
into and Hully bended those goods. Also this I name to show to your Lordship the danger then would be
allowing this person to return to his old associates because it is believed in Ashton that there are more
of the same gang Remaining which Hully might have impeached.
My Lord I consider the importance of this communication to your Lordship Sufficient to appoligize for the liberty I have taken in adressing your Lordship. I am sorry that I could not forward a copy of the
conviction but of course your Lordship can obtain that from Jas. Norris Esq., Chairman of the New
Bailey Sessions Salford
Manchester.
An answer My Lord Stating
weather you have been petitioned or not
in behalf of this convict will
Oblige My Lord
Your Lordships
Ashton under Lyne Devoted and very Huble Servt

the Prosecutor.

- May it please your Lordship
We the undersigned, Inhabitants of the parish of Ashton under Lyne, in the County of Lancaster
- Humbly sheweth, that Robert Hully a native of this parish now a prisoner in the General Penitentiary
Millbank, being sentenced by the Salford Quarter Sessions in May 1829 on a conviction of Theft, and
from his previous good character and the unfortunate manner in which he got linked in the affair, being
the first in his life, - the Court mitigated his punishment to five years imprisonment.
Your Memorialists have great reasons to suppose, that from the very good behaviour whilst in the
Penitentiary, and from the good character which he had always borne your Lordship would be pleasd to
order his release from prison that he could be restor'd to his wife and family. And your Memorialists feel
convinc'd that he will for the future conduct himself with propriety, having already felt the sufficient
impression and punishment for his unfortunate circumstance.
And Your Memorialists
Will ever Pray
